These Terms of Service (the "Terms") govern your access to and use of the YouraHub mobile application and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Who we are; Apple disclaimer
The Service is provided by YouraHub Team ("YouraHub", "we", "us", "our"). These Terms are an agreement between you and YouraHub Team, not Apple Inc. ("Apple"). Apple is not responsible for the Service and has no obligation to provide maintenance or support for the Service. You must also comply with applicable third-party terms, including any Apple App Store and Apple Media Services terms that apply to your download or use of the Service.
2) Eligibility (17+)
The Service is intended for users who are at least 17 years old. By using the Service, you represent that you meet this requirement.
3) The Service
YouraHub helps you transform photos into atmospheric cards, apply summer-style organization, and add stylistic elements such as Morandi-style borders. You may also add voice memos and organize your creations. The Service may evolve over time; we may add, modify, or remove features to improve the Service, comply with law, or ensure safety and performance.
4) Accounts
- Account information: To use certain features, you may need an account and may be asked to provide your name, username, and email.
- Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.
5) User Content
You may submit or upload content such as photos, images, text, and voice memos (collectively, "User Content"). You retain ownership of your User Content as between you and us.
You grant YouraHub Team a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely to provide, maintain, and improve the Service and to fulfill your requests (for example, generating photo card outputs). This license ends when your User Content is deleted from our systems, except to the extent required for legal compliance, security, or backups.
You are responsible for your User Content and represent that you have all rights necessary to upload and use it, and that it does not violate law or others' rights.
6) AI-assisted features (if available)
If the Service includes AI-assisted processing (such as applying style transformations or generating enhanced outputs from your photos and/or text), you control whether you upload content and request generation. We process uploaded content on servers controlled by YouraHub Team, do not share it with third parties for processing, and delete it immediately after the requested processing is completed, as described in our Privacy Policy.
7) Photos, face-related data, and biometrics
The Service does not perform face recognition and does not collect or store biometric identifiers. Photos are used only to fulfill your requested generation/enhancement and are not used for training or marketing profiling.
8) Acceptable use
You agree not to:
- Use the Service in a way that violates law or infringes others' rights.
- Upload content you do not have rights to use.
- Attempt to reverse engineer, circumvent security, or interfere with the Service.
- Use the Service to distribute malware, spam, or abusive content.
- Abuse, harass, or threaten others.
9) Feedback
If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation, provided we do not publicly attribute them to you without permission.
10) Third-party services
The Service may interact with third-party services or links. We are not responsible for third-party services and your use of them is governed by their terms and policies.
11) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, we must do so to comply with law, or to protect the Service, users, or YouraHub Team. Upon termination, your right to use the Service will end.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURAHUB TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURAHUB TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL YOURAHUB TEAM'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO YOURAHUB TEAM FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $50 IF YOU PAID NOTHING), TO THE EXTENT PERMITTED BY LAW.
14) Changes to these Terms
We may update these Terms from time to time. We will update the Effective Date above and may provide notice in the app where required. Continued use of the Service after changes become effective means you accept the updated Terms.
15) Governing law; dispute resolution; arbitration
Governing law: These Terms are governed by the laws of YouraHub Team's principal place of business, without regard to conflict of laws rules, except where local consumer protection laws require otherwise.
Binding arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by a recognized arbitration institution in the jurisdiction of YouraHub Team's principal place of business. The arbitration will be conducted in English by a single arbitrator. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
